In the decision in this proceeding served on September 27, 2012, the Board explained that its analysis of the record in the highly confidential version of the appendix was initially provided only to the parties’ outside counsel due to the prevalence of competitively sensitive information contained therein.  The decision indicated that a public version of the appendix would be released after the parties were given an opportunity to propose redactions of any confidential and highly confidential information contained in the highly confidential version of the appendix.

 

Pursuant to this notice, the Board’s prior decision is being updated to include the public version of the appendix submitted by the parties on November 13, 2012.  The public version of the appendix should replace page 22 of the decision served on September 27, 2012.  An updated version of the decision will be available on the Board’s website.
